Marijuana Possession Laws & Penalties in Mississippi
In Mississippi, simple marijuana possession is decriminalized for first-time offenders. Possession of up to 30 grams of cannabis is punishable by a maximum fine of $250.
A second conviction carries a maximum jail term of 60 days – with a mandatory minimum sentence of five days – and a fine of up to $250. A third or subsequent conviction will result in a maximum 60-day jail sentence and a fine no more than $1,000.
However, if up to 30 grams of pot is found in a vehicle, it is a misdemeanor offense that carries a jail term of up to 90 days and a maximum fine of $3,000. This means you could face misdemeanor charges on a first offense.
Possession of between 30 and 250 grams of cannabis is punishable by imprisonment for up to three years and a fine of up to $3,000. Possession of between 250 and 500 grams of marijuana carries a prison term of up to eight years and a fine not exceeding $50,000.
Possession of between 500 grams and one kilogram is punishable by imprisonment for up to 16 years and a maximum fine of $250,000. Possession of between one and five kilograms can result in imprisonment for up to 24 years and a fine no more than $500,000. Lastly, possession of five kilograms or more is punishable by a maximum 30-year prison sentence and a fine of up to $1,000,000.
Keep in mind, possession of larger amounts of marijuana could lead to marijuana sales and trafficking charges. Marijuana trafficking could bring federal charges, which are punishable by harsher penalties.
